DENVER (KDVR) — The father of Elijah McClain, whose death after a violent arrest helped galvanize the 2020 protests against police brutality, was arrested Saturday in a case where law enforcement said he assaulted a trooper and was hit with a Taser in response.
Lawayne Mosley faces counts of driving under the influence and second-degree assault on a peace officer, among other charges, according to a Monday night release from Colorado State Patrol. Investigators say Mosley, who was stopped on suspicion of DUI, “physically assaulted” a state trooper, and a responding county deputy used a stun gun against Mosley.
CSP said it distributed the information because of “multiple media inquiries.”
FOX31 has attempted to reach Mosley for comment and has requested police body and dash camera video of the incident.
Court records show Mosley is due in court on Thursday for the filing of charges. He remained in the Arapahoe County jail as of Monday night.
CSP describes arrest of Elijah McClain’s father
The incident began just before 5:30 p.m. Saturday off Interstate 70 and Manilla Road, near Bennett. CSP said someone reported a driver for weaving and not maintaining speed, and the driver had pulled into an Adams County gas station off the interstate.
Here is how CSP described the account of what happened: “The Trooper contacted the suspected impaired driver while the driver was still in his vehicle. The driver, Mr. Lawayne Mosley, did not comply with the trooper’s instructions to exit the vehicle per normal DUI investigation practices. As the trooper began to assist Mr. Mosley from the vehicle, the trooper was physically assaulted by Mr. Mosley. An Adams County Sheriff’s Deputy, who arrived on the scene during this time, tased Mr. Mosely to assist in his arrest. Medical personnel arrived on the scene. Treatment was offered to Mr. Mosley and the trooper, and the trooper did accept on-site treatment.”
CSP said at one point during the arrest, Mosley identified himself as McClain’s father. They said he was not hurt besides where the Taser hit him.
CSP said Mosley cooperated with a blood test in the DUI investigation and was booked into the Arapahoe County jail on the following charges:
Second-degree assault on a peace officer
Driving under the influence
Resisting arrest
Careless driving
Possession of a weapon while under the influence

Elijah McClain case started with report of ‘suspicious’ person
The death of Mosley’s son in 2019 later helped galvanize the 2020 protests against police brutality, spurred criminal prosecutions against the officers and paramedics who were involved and led to changes in Aurora police policy.
McClain was stopped by police after a 911 caller reported that he looked suspicious. Another officer put his hands on McClain within seconds, beginning a struggle and restraint that lasted about 20 minutes before paramedics injected him with the ketamine.
Experts say the sedative ultimately killed McClain, who was already weakened from struggling to breathe while being pinned down after inhaling vomit into his lungs.
A former Aurora police officer was sentenced to 14 months in jail in the 23-year-old’s death.
In a separate trial, two paramedics were convicted recently for injecting McClain with an overdose of the sedative ketamine after police put him in a neck hold that’s now banned in Colorado. Sentencing for the paramedics will come in March.
