(PALMER LAKE, Colo.) — According to a community nonprofit that challenged the legality of the annexation process for a proposed Buc-ee’s travel center in Palmer Lake, the request for annexation has been withdrawn for the development.
The community groups Integrity Matters and TriLakes Preservation, which previously sued the Town of Palmer Lake over allegations of statutory and constitutional violations, provided an update on Thursday, March 13, and said the annexation request for the proposed Buc-ee’s development near I-25 and County Line Road had been withdrawn.
“This decisive turn of events moots the current lawsuit, but it validates that our legal challenge was justified,” Integrity Matters said in a joint press release.
Integrity Matters said while the withdrawal negates the current lawsuit, the landowner and the Town of Palmer Lake have made their intentions clear to resubmit the annexation application.
“The withdrawal of the annexation for a proposed Buc-ee’s does not erase the constitutional rights violations, censorship, and harassment perpetrated by Palmer Lake officials,” said Integrity Matters. The group said it supports a movement by Palmer Lake locals in calling for the recall of three Board of Trustees members who have “engaged in conduct that violates the rights of Palmer Lake and Tri-Lakes citizens.”
