(COLORADO) — The Supreme Court has rejected Robert Dear’s petition regarding a previous order from a Colorado judge that permitted his forcible medication.
In late January, Dear filed a petition with the highest court to “resolve an important circuit split regarding the procedural requirements for ordering involuntary medication,” a few months after a judge declared he could be forced to take antipsychotic medication.
Robert Lewis Dear is charged with allegedly killing three people and wounding several others at a Planned Parenthood in Colorado Springs in 2015. Court documents previously stated that Dear suffered from delusional disorder, persecutory type and it was “historically believed to be resistant to medication.”
Dear has been awaiting trial since 2015, after being found incompetent to stand trial and having been committed to hospitalization until he is determined to understand the charges against him or assist in his defense.
On Monday, Feb. 24, the Supreme Court denied Dear’s petition, meaning he will be forcibly medicated to stand trial. Dear is set to be in court for a hearing on May 16.
