Lawsuit filed against former, current Custer County deputies

(CUSTER COUNTY, Colo.) — A lawsuit has been filed against three former Custer County deputies and one current detention deputy, alleging excessive force in an incident involving a 16-year-old in 2022.

According to the Custer County Sheriff’s Office (CCSO), its agency was notified of the lawsuit on Wednesday, Jan. 17. The lawsuit alleges that a former deputy used excessive force while arresting a 16-year-old and that two other former deputies and one current detention deputy failed to intervene.

CCSO said the incident happened on Jan. 18, 2022, under a previous Sheriff’s administration.

“The current sheriff, Rich Smith, has not been served yet with the lawsuit but is very concerned about the allegations,” CCSO said in a Facebook post. CCSO said that Sheriff Smith has requested that the Colorado Bureau of Investigation review the incident, which was documented on body-worn cameras and in police reports.

According to CCSO, Sheriff Smith volunteered to support their findings, “up to and including the possibility of criminal charges.” Sheriff Smith also notified the director of Colorado Peace Officer Standards and Training (POST) of the allegations.
