(COLORADO) — Court records show that the man accused of killing three people at a Planned Parenthood clinic in Colorado Springs in 2015 has filed an appeal with the U.S. Supreme Court, a few months after a judge declared that he could be forcibly medicated to stand trial.
The petition asks the court to “resolve an important circuit split regarding the procedural requirements for ordering involuntary medication.” Court documents state that Robert Lewis Dear suffered from delusional disorder, persecutory type and it is “historically believed to be resistant to medication.”
Dear is charged with allegedly killing three people and wounding several others at a Planned Parenthood during the 2015 November shooting.
Dear has been awaiting trial since 2015, after being found incompetent to stand trial and having been committed to hospitalization until he is determined to understand the charges against him or assist in his defense. On Thursday, Feb. 13, Dear had a status hearing and is set to be back for another hearing on May 16.
There is no word on if the highest court would decide if they want to hear the case.
